I was somewhat surprised to have a Panthers fixtures flyer passed to me last night as it had my picture on it. The flyers were sent out in the free papers and suchlike and the rather random fan shot has someone's chest, my face and Twix grinning on it.
I don't really mind, but with all these new rules over taking photos, does this mean that my picture (and any other fan's picture for that matter) is the property of the Panthers Organisation because I've walked into their arena ? I think we should be told.
I could scan the leaflet in question and post it up, but I'm not sure if that breaks the forum rules on photography. Did anyone else see it ?

Rhino#13 and Twix will be at the Arena signing fixture card flyers this Sunday.
Those wishing to get signatures are advised to arrive early as long queues are expected.
Racism, bad language, and photography (of any kind) will not be tolerated.

Don't knock it. Isn't that how Pamela Anderson's career started, being filmed at a baseball game or something?
You could be donning that red bathing suit in a matter of days, and more importantly, meeting the Hoff. Follow that up with some minor drug issues, making your own porn film (and accidentally loading it up on the interweb), marrying an old rocker in Hawaii and contracting an incurable illness. Think yourself lucky. I dream of such a future.
Every week I have a shave and squeeze my spots in the vain attempt to further my modelling career, but nothing. I must change my seat to Block 15 as it would appear that's where the scouts are checking.

I wonder if that's the shot that my friend saw Dave take after the Belfast game recently. I wondered when none appeared on his site. I hate having my photo taken at the best of times!

Surely the Human Rights Act that says we have the right to retrieve any video or photo of ourselves be it on security camera or any other survelance/recorded device. So surely this even in the terms and conditions is superceeded by the law?

A friend of mine had her image plastered all over the side of a bus in a Giants advertising campagin.
However on the legal front, by entering into a sports ground/arena in this country you agree to be bound by the promoters terms and conditions, usually one of the conditions is that your image or voice may be recorded and used in any subsequent advertising or promotional way that the promoter seems fit.
Photographers would usually draw the line at using kids photos, and personally if a picture of mine was to be used in such a way then I would try my best to forewarn the person (if possible), however DP probably hands a disc full of images to the printers and they pick what they want, as is probably the agreement he has with them.
The agreement I have with Dataco (Football Premiership image rights owners) states I cannot do anything with the images I take without their strict (and well policed) agreement, I cant even post one here.
However if i get my arse kicked black and blue outside a club, and number of TV shows can show this CCTV footage, the world has gone mad.

The Freedom of Information Act gives everyone the right to access information held by the public sector. It doesn't however effect the terms and conditions you agreed to when purchasing and using your ticket. An example of it in use - A student at Nottm Uni was tackled to the ground by a member of Security and subsequently barred from certain areas because he had supposedly acted in a violent and threatening manner towards the guard. The student requested the CCTV footage which clearly shows that it was Security who instigated the incident, and only them who acted violently.

Spot on. You enter an arena/rink/concert hall and the promotors can do what they like with your image - you are, afterall, only a face in the crowd. What a photographer cannot do is pick out a child in the crowd and post his/her image only on a website or print the picture without the parent's permission. However if that kid is a blurred face, or you cannot make out his/her image in any way then that's OK. Different situation really but that's why you won't often find photos of Lions' players who wear face-cages. We don't know if the parent has given permission for the photo to be taken, or if theres a legal reason that child cannot have an image on the internet.
