I totally agree that Panthers can object to having pics taken at the game . But assume that pro photoraphers own their own work.
I assume Dave has an agreement with Panthers before picture taking starts. ie) Can sell his pics but allow Panthers pics for media etc...or even get a cut from sales.
In the past Photograthers were allowed in as they represented Magazines and themselves.Either paying a fee or for the sake of the sport being allowed access for the league programme. Thus copyright with the photo taker at the end of the day.
But now a request is made for no pics to be taken for unofficial use unless permission granted , so I guess photographers (other than Dave) are surplus now or have to bide by a rule newly set up. But then again why would they take pics if they cant do as they wish with them?

Spik - I will answer your mail in more detail when i get 10 mins or so. As for the above point, it all depends on the arrangement between photographer and client. Myself and the Panthers had an 'understanding' and proceeds from all sales (media and the concourse) were split, the whole image rights never came up apart from when a certain ex player decided he wanted his cut of the profits from his photo sales (which funnily enough he got). Like i have said before and no one seems to be listening i take photos at football but am only allowed to sell them to authorised buyers, the promoter (in my case the Barclays Premiership) owns all the rights to the content in my photos. Upon enetring the NIC you agree to be bound to their terms and conditions, one of which is NO photography, if it says it on the ticket or not, like it does not say no urinating on the concourse, which of course isnt allowed either

It comes down to the fact that its smply NOT TURE that a photographer owns the copyright to an image automatically.
This might be the case if you are at a free event or in public. And even then if I was snapped out and about I would have a rights if my image was used in a way I didnt want.
In the same way as MG he takes football photos. The players are the clubs image, the rink and logos are the clubs image and therefore the club can say who is allowed to take photos for the public domain. Not the photographer

I am looking back a few years.
Photographers entered buildings , taking pics for magazines and themselves. Did they pay for the privilage? Was entry free but Panthers got a cut?
Was the taker on a salary and pics were for the use of the magazine only. I assume not as I had pics from these guys on an agreement in my book and if similar pics are still on the same roll why can they again not let these out?
Before Elite there was Superleague and before them others with interests.
I do believe a club has rights to defend its product/image but the photographer must have this also.
In the 80's I knew a guy took pics for hockey. He did this as an interest. He provided good pics for the club but also used the pics for himself, getting credits in magazines. I gather he'd assume no different today with those pics he had taken.
